1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute an agreement between Dealique, operated by Fabugit Enterprise, and you, the user of our services. By using the Dealique platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.

2. Age Restriction

Dealique and its services are intended for individuals aged 18 and above. We do not knowingly engage with individuals under the age of 18.

3. Payment Services

Dealique offers a platform that enables you to make and receive payments to and from others (referred to as “payment transactions”). We create and maintain a payment account for you to facilitate these transactions. You can request a copy of these Terms at any time.

4. Use of Your Account

Your Dealique account is for personal use, unless you are set up as a Business customer. You may use it solely for making payment transactions. Your account should not be used for storing funds unrelated to specific payment transactions. You cannot access your account for purposes other than amending or canceling your payment orders. Your login details are for placing payment orders and viewing transaction records but do not grant access to your account’s funds. You must not use your account for illegal activities. Dealique reserves the right to terminate or suspend your account at any time for violations of these Terms and Conditions or for any other reason.

5. Funding Your Account

Funds in your account will be held in accordance with the Escrow section of these Terms. We do not pay interest on funds in your account. You can fund your account using accepted mechanisms such as direct bank transfer, USSD, credit or debit card payments, the Pay-By-Bank-App, or other available methods. Please ensure that you provide funds equal to the intended payment transaction, including escrow service charges.

6. Payment Transactions

Payment transactions consist of:

  • Payment to Dealique from your bank or credit card provider to fund your account.
  • An instruction to us to make a payment transaction to another user (payment recipient).

In order to initiate a valid payment order, you must provide payment recipient details, specify the payment amount, provide a transaction description, and set conditions (e.g., immediate payment, future date, or satisfaction of specific conditions). A valid payment order is only complete once we credit the corresponding funds to your account. You agree to complete transactions in accordance with Dealique’s guidelines, including payment, delivery, and confirmation of receipt. Dealique may charge fees for certain services. These fees and payment terms will be clearly disclosed before you complete a transaction.

7. Completion of Transactions

Upon receiving a valid payment order, we hold the funds in your account until the specified release time. At that time, we complete the payment transaction by transferring funds to the payment recipient’s nominated account. We make payments using the chosen method, and you should allow a minimum of 24 hours from funding for funds release.

8. Dispute Resolution

Users can select a dispute resolution procedure when initiating a transaction. Procedures may include mutual resolution or third-party resolution for certain transactions above a specified threshold. Funds remain in escrow until disputes are resolved.

9. Payment Refunds

Canceled transactions or partial refunds will be refunded to the source of payment. Transaction fees are non-refundable.

10. Fund Safeguarding

Funds in your account are held separately in a “transactional account” to protect your interests. We comply with regulatory obligations to safeguard user funds.

11. Liability Limitations

Dealique is not responsible for losses or costs resulting from unforeseeable events or regulatory changes outside our control. We fulfill our obligations to the extent possible within legal and regulatory constraints.

12. Changes to Terms

Dealique may update these Terms and Conditions from time to time. Users will be notified of any changes, and continued use of the Platform constitutes acceptance of the revised terms.

13. Privacy

Your use of Dealique is governed by our Privacy Policy. Please review this policy to understand how we collect, use, and protect your information.
